TERMS AND CONDITIONS
of the Online Store

§1 General Information

1. The online store available at https://artofchild.eu (hereinafter referred to as the
   “Store”) is operated by Veronika Shevtsova, acting in the form of an unregistered business
   activity pursuant to Article 5 of the Act of 6 March 2018 – Entrepreneurs’ Law.
2. Seller’s contact details:

   b) correspondence address: ul. Opolska 23a/22, Wrocław, 52-010, Poland.
3. These Terms and Conditions define the rules for using the Store, placing and fulfilling
   orders, as well as the rights and obligations of the parties.
4. The Terms and Conditions are available free of charge on the Store’s website in a form
   enabling their saving and printing.
5. To use the Store, the following are required:
   a) access to the Internet,
   b) an up-to-date web browser,
   c) an active e-mail account.

§2 Definitions

1. Seller – the natural person Veronika Shevtsova.
2. Online Store – the online store operating at artofchild.eu, run by the Seller.
3. Client – an adult natural person.
4. Artwork – a painting or other artistic work of the Seller, ready-made or made to order.
5. Custom-made Artwork – a painting, bas-relief, sculpture or other artistic work created
   according to individual arrangements after acceptance of a contract for specific work.
6. Contract for Specific Work – a contract concerning the creation of a custom-made
   artwork.
7. Order – a declaration of intent by the Client aimed at concluding a contract for the
   purchase of a product.

§3 Artistic Nature of the Works

1. All artworks offered in the Store are unique works of art, handmade by the artist
   Veronika Shevtsova.
2. Due to the individual and artistic nature of the works:
   a)artworks may slightly differ from the photographs presented in the Store,
   b) minor differences in color, texture, or composition do not constitute a defect.
3. Product photographs are for illustrative purposes only and may slightly differ in color
   depending on the color display settings of the device screen.

§4 Social Media

1. The Store contains links to the Seller’s social media profiles, in particular:
   c) Instagram,
   d) Facebook,
   e) Pinterest,
   f) YouTube.
2. These links are provided for informational and promotional purposes.
3. The Seller shall not be liable for the content, terms and conditions, or privacy policies of
   external websites.

§5 Types of Contracts

1. The following contracts are concluded in the Store:
   a) sales contracts – for ready-made artworks;
   b) contracts for specific work – for artworks created on individual order.
2. The type of contract is clearly indicated to the Client each time when placing an order.

§6 Placing Orders and Price Determination

1. Orders may be placed:
   g) by e-mail,
   h) by phone.
2. In the case of custom-made artworks:
   a) the price, completion time, and delivery method are agreed individually via e-mail;
   b) upon acceptance of the arrangements by the Client, a contract for specific work is
   concluded.
3. After acceptance of the price and delivery method, the Client makes a one-time
   payment for the entire order via the payment platforms available on the website, unless the
   contract for specific work provides otherwise (e.g. an advance payment).
4. Placing an order constitutes acceptance of these Terms and Conditions.

§7 Prices and Payments

1. Prices in the Store are stated in Polish zloty (PLN). If the Client wishes to pay in
   another currency, this is agreed individually by e-mail.
2. The Seller is not a VAT taxpayer.
3. In the case of a custom-made artwork:
   a) an advance payment applies in the amount specified in the contract for specific work
   (standardly 60%),

b) the remaining part of the remuneration is payable in accordance with the terms of the
contract.

§8 Fulfillment and Delivery

1. Delivery of artworks within Poland is free of charge. The delivery method is selected
   when placing the order.
2. For orders with delivery outside the territory of Poland, the Client is requested to
   contact the Seller by e-mail before placing the order.
3. After e-mail contact, the Seller will present the Client with available international
   delivery options, including:
   a) the delivery method,
   b) the estimated delivery time,
   c) the delivery cost.
4. Fulfillment of an order with international delivery takes place after the Client’s
   acceptance of the proposed delivery conditions and full payment of the order.
5. Delivery times are indicative and may change due to circumstances beyond the Seller’s
   control.
6. The Client is obliged to inspect the shipment at the time of receipt.

§9 Right of Withdrawal from the Contract

1. The Client has the right to withdraw from the contract for the purchase of a ready-made
   artwork within 14 calendar days from the date of concluding the contract. After
   withdrawal, the Client has a further 14 calendar days to return the artwork to the address
   indicated by the Seller.
2. The right of withdrawal does not apply to custom-made artworks created according to
   individual specifications (Article 38(3) of the Act on Consumer Rights).

§10 Complaints

1. The Seller is liable for the lack of conformity of the artwork with the contract.
2. Complaints should be submitted by e-mail.
3. Complaints are considered within 14 calendar days.

§11 Respect for Intellectual Property

1. All copyrights to artworks, paintings, content, photographs, descriptions, and materials
   published in the Store belong to the Seller.
2. The purchase of an artwork does not result in the transfer of economic copyrights.
3. Copying, distributing, or using artworks or Store content without the Seller’s written
   consent is prohibited.

§12 Cookie Policy

1. The Store uses cookies for the purpose of:
   a) ensuring proper operation of the website,
   b) improving functionality,
   c) conducting statistics (if applicable).
2. Detailed rules regarding the use of cookies are described in the Cookie Policy available
   on the Store’s website.
3. Users may manage cookies through their browser settings.

§13 Limitation of Liability

1. The Seller shall not be liable for:
   a) incorrect data provided by the Client,
   b) delays resulting from causes beyond the Seller’s control,
   c) differences resulting from the artistic nature of the artwork.
2. The Seller’s liability is limited to the extent provided for by applicable law.

§14 Personal Data

1. The Seller is the controller of personal data.
2. The rules of personal data processing are set out in the Privacy Policy.

§15 Final Provisions

1. These Terms and Conditions are effective as of 10 January 2026.
2. The Seller reserves the right to amend the Terms and Conditions.
3. In matters not regulated herein, Polish law shall apply.

   website artofchild.eu, operated by Veronika Shevtsova, acting in the form of an
   unregistered business activity.

§1 Informacje ogólne

1. Sklep internetowy dostępny pod adresem https://artofchild.eu (dalej: „Sklep”)
   prowadzony jest przez Veronikę Shevtsovą, działającą w formie działalności
   nierejestrowanej, zgodnie z art. 5 ustawy Prawo przedsiębiorców.
2. Dane kontaktowe Sprzedawcy:
   a) adres e-mail: contact@artofchild.eu
   b) adres do korespondencji: ul. Opolska 23a/22, Wrocław, 52-010, Polska.
3. Regulamin określa zasady korzystania ze Sklepu, składania zamówień, realizacji
   zamówień oraz prawa i obowiązki stron.
4. Regulamin jest dostępny nieodpłatnie na stronie Sklepu w formie umożliwiającej jego
   zapisanie i wydrukowanie.
5. Do korzystania ze Sklepu niezbędne jest:
   a) dostęp do Internetu,
   b) aktualna przeglądarka internetowa,
   c) aktywne konto e-mail.

§2 Definicje

1. Sprzedawca – osoba fizyczna Veronika Shevtsova.
2. Sklep internetowy – sklep internetowy pod adresem artofchild.eu prowadzony
   przez Sprzedawcę;
3. Klient – osoba fizyczna pełnoletnia.
4. Dzieło artystyczne – obraz artystyczny lub inny wyrób artystyczny Sprzedawcy
   gotowy lub na zamówienie.
5. Dzieło artystyczne na zamówienie – obraz, płaskorzeźba, rzeźba lub inny wyrób
   wykonywane według indywidualnych ustaleń po akceptacji umowy o dzieło.
6. Umowa o dzieło – umowa dotycząca wykonania obrazu na zamówienie.
7. Zamówienie – oświadczenie woli Klienta zmierzające do zawarcia umowy przy
   nabyciu produktu.

§3 Charakter twórczości artystycznej

1. Wszystkie dzieła artystyczne oferowane w Sklepie są unikatowymi dziełami sztuki,
   wykonywanymi ręcznie przez artystkę Veronikę Shevtsovą.
2. Ze względu na indywidualny charakter twórczości:
   a) Dzieła artystyczne mogą nieznacznie różnić się od zdjęć prezentowanych w Sklepie,
   b) drobne różnice kolorystyczne, fakturalne i kompozycyjne nie stanowią wady.
3. Zdjęcia Produktów mają charakter poglądowy i mogą nieco się różnic kolorystycznie
   w zależności od odwzorowania barw urządzenia z ekranem

§4 Social media

1. Sklep zawiera odnośniki (linki) do profili Sprzedawcy w mediach społecznościowych,
   w szczególności:
   c) Instagram,
   d) Facebook,
   e) Pinterest
   f) You Tube
2. Linki te mają charakter informacyjny i promocyjny.
3. Sprzedawca nie ponosi odpowiedzialności za treści, regulaminy ani polityki
   prywatności serwisów zewnętrznych.

§5 Rodzaje umów

1. W Sklepie zawierane są:
   a) umowy sprzedaży – dla gotowych dzieł artystycznych;
   b) umowy o dzieło – dla dzieł artystycznych wykonywanych na indywidualne
   zamówienie.
2. Rodzaj umowy jest każdorazowo jasno wskazany Klientowi przy składaniu
   zamówienia.

§6 Składanie zamówień i ustalanie ceny

1. Zamówienia można składać:
   g) drogą mailową,
   h) telefonicznie.
2. W przypadku obrazów na zamówienie:
   a) cena, termin realizacji oraz metoda dostawy ustalane są indywidualnie drogą
   mailową.
   b) po zaakceptowaniu ustaleń przez Klienta, dochodzi do zawarcia umowy o dzieło.
3. Po akceptacji ceny oraz metody dostawy Klient dokonuje jednorazowej płatności za
   całość zamówienia poprzez dostępne platformy na stronie, chyba że umowa o
   dzieło stanowi inaczej (np. zadatek).
4. Złożenie zamówienia oznacza akceptację Regulaminu.

§7 Ceny i płatności

1. Ceny w Sklepie podawane są w złotych polskich, jeżeli Konsument chce zapłacić w
   innej walucie – ustala się to mailowo.
2. Sprzedawca nie jest podatnikiem VAT.
3. W przypadku obrazu na zamówienie obowiązuje:
   a) zadatek w wysokości określonej w umowie o dzieło (standardowo 60%).
   b) Pozostała część wynagrodzenia płatna jest zgodnie z warunkami umowy.

§8 Realizacja i dostawa

1. Dostawa obrazów na terenie Polski jest bezpłatna, metoda dostawy jest wybierana
   przy składaniu zamówienia.
2. W przypadku zamówień z dostawą poza terytorium Polski, Klient proszony jest o
   kontakt mailowy ze Sprzedawcą przed złożeniem zamówienia.
3. Po kontakcie mailowym Sprzedawca przedstawi Klientowi propozycję dostępnych
   opcji dostawy zagranicznej, w tym:
   a) metodę dostawy,
   b) orientacyjny czas realizacji,
   c) koszt dostawy.
4. Realizacja zamówienia z dostawą zagraniczną następuje po akceptacji przez
   Klienta zaproponowanych warunków dostawy i całkowitej opłacie zamówienia.
5. Terminy realizacji mają charakter orientacyjny i mogą ulec zmianie w przypadku
   zdarzeń niezależnych od Sprzedawcy.
6. Klient zobowiązany jest sprawdzić przesyłkę w chwili jej odbioru.

§9 Prawo odstąpienia od umowy

1. Klient ma prawo odstąpić od dnia zawarcia umowy zakupu gotowego dzieła
   artystycznego w terminie 14 dni kalendarzowych. Po odstąpieniu od umowy, klient
   ma kolejne 14 dni kalendarzowych na odesłanie dzieła artystycznego na adres
   podany przez Sprzedawcę.
2. Prawo odstąpienia nie przysługuje w przypadku wykonanego dzieła artystycznego
   na indywidualne zamówienie (art. 38 pkt 3 ustawy o prawach konsumenta).

§10 Reklamacje

1. Sprzedawca odpowiada za brak zgodności dzieła artystycznego z umową.
2. Reklamacje należy zgłaszać mailowo.
3. Reklamacje rozpatrywane są w terminie 14 dni kalendarzowych.

§11 Poszanowanie własności intelektualnej

1. Wszelkie prawa autorskie do dziel artystycznych, obrazów, treści, zdjęć, opisów oraz
   materiałów publikowanych w Sklepie przysługują Sprzedawcy.
2. Zakup dzieła artystycznego nie oznacza przeniesienia autorskich praw
   majątkowych.
3. Zabronione jest kopiowanie, rozpowszechnianie i wykorzystywanie dzieł oraz treści
   Sklepu bez pisemnej zgody Sprzedawcy.

§12 Polityka cookies

1. Sklep wykorzystuje pliki cookies w celu:
   d) zapewnienia prawidłowego działania strony,
   e) poprawy funkcjonalności,
   f) prowadzenia statystyk (jeśli dotyczy).
2. Szczegółowe zasady stosowania cookies opisane są w Polityce Cookies dostępnej na
   stronie Sklepu.
3. Użytkownik może zarządzać plikami cookies poprzez ustawienia przeglądarki.

§13 Ograniczenie odpowiedzialności

1. Sprzedawca nie ponosi odpowiedzialności za:
   g) błędne dane podane przez Klienta,
   h) opóźnienia wynikające z przyczyn niezależnych od Sprzedawcy,
   i) różnice wynikające z artystycznego charakteru dzieła.
2. Odpowiedzialność Sprzedawcy ograniczona jest do zakresu przewidzianego
   przepisami prawa.

§14 Dane osobowe

1. Administratorem danych osobowych jest Sprzedawca.
2. Zasady przetwarzania danych określa Polityka Prywatności.

§15 Postanowienia końcowe

1. Regulamin obowiązuje od 10.01.2026.
2. Sprzedawca zastrzega sobie prawo do zmian Regulaminu.
3. W sprawach nieuregulowanych stosuje się prawo polskie.
